Lerderderg Legal Pty Ltd (trading as Lerderderg Legal) (we, our, us) recognise the importance of protecting the privacy and the rights of individuals in relation to their personal information and sensitive personal information. This document is our privacy policy and it describes how we collect and manage your personal information. We always aim to collect only information which we need to be able to provide legal and/or corporate governance & secretariat services and ancillary services to you.
Lerderderg Legal’s legal obligations in respect of privacy are stipulated in the Privacy Act 1988 (Cth), the associated Australian Privacy Principles, the Privacy Amendment (Notifiable Data Breaches) Act 2017 (Cth) and all regulations and other subordinate legislation effected under the Privacy Act. Lerderderg Legal complies with all of these legal requirements.
1. What is your Personal Information – What is this?
Generally, this is any information that may be used to personally identify you. This may include your name, address, email address, mobile number, partnership status. In some cases, personal information may also be considered as “sensitive” such as your bank account details and medical records. If the information we collect personally identifies you, or you are reasonably identifiable from it, the information will be considered personal information.

We collect personal information from our clients to be able to provide to you the best quality professional legal services. In some cases, we gather information which is not personally identifiable information but which may be treated as confidential information in accordance with our legal terms and conditions contained in our engagement letter with you.
3. How do we collect your personal information?
In most cases we collect personal information from you as part of our client on-boarding process and during the term of our engagement as your legal advisor. We may commence the collection of your personal information from the time that you first contact us through our website or direct contact by phone or otherwise. It is likely that we will continue to collect personal information as you provide detailed instructions to us.

Device Information We may collect information about the computer, mobile telephone, smart phone, or other device you use to access this website.
Cookies When you access our website, we may send a “cookie” (which is a small summary file containing a unique ID number) to your computer. This enables us to recognise your computer and welcome you more efficiently each time you visit our website. It also enables us to keep track of products or services you view so that, if you consent, we can send you news about those products or services. If you do not wish to receive cookies, you can set your browser so that your computer does not accept them.
5. How we use the information we collect
5.1. To provide you with legal services We generally use personally identifying information you supply to provide you with the service you have requested. For example, if we provide you with legal advice, we may use your email address or phone number to communicate with you. We will use and may disclose your personal information in the course of providing our legal services to you. In providing these services we may disclose your personal information to third parties including counterparties to your business transaction and their lawyers, government bodies such as IP Australia to enable us to apply for a trade mark on your behalf, courts or tribunals to represent you at a legal hearing. Disclosures to third parties are only made with your consent. We may also use your personal information to communicate with you about interesting legal updates, seminars and podcasts.
5.2. Third party service providers. We may disclose your personal information to third parties that provide services on our behalf such as accounting services, including credit-card and invoice processing, IT services or web development services. Our service providers are restricted from using any data in any way other than to provide services to us.
5.3. Our email policy. We comply with applicable marketing laws, including the Spam Act 2003 (Cth). If we send you a newsletter about updates to laws or general information about our services including events, these emails will include an easy to use unsubscribe facility.
5.4. Legal Requirements. In order for us to cooperate with official investigations or legal proceedings, including, for example, in response to subpoenas, search warrants, court orders, or other legal proceedings we may be required to disclose your personal information.
7. Do we disclose your personal information to anyone outside Australia?
We may disclose personal information to our third party suppliers and service providers located overseas for some of the purposes listed above. We take reasonable steps to ensure that the overseas recipients of your personal information do not breach the privacy obligations relating to your personal information. We may disclose your personal information to entities located outside of Australia, including the following: our related bodies corporate, our data hosting and other IT service providers, located in foreign countries (some cloud service providers may store data in several countries) and other third parties who may be located outside of Australia.

8.1. Technical Security. We have implemented a variety of commercially standard security technologies and procedures to protect information, including your personal information, stored in our computer systems from unauthorised access. Please be aware that no method of transmission over the internet, or method of electronic storage, is 100% secure. We strive to use commercially acceptable means to protect your personal information but we cannot guarantee its absolute security under all conditions.
8.2. Management Procedures. We also maintain standard physical and electronic procedural safeguards that limit access to your personally identifiable information.
